Closely adhering to its immigration levels plan for 2021-2023, the federal and provincial governments have issued nearly 27,000 invitations to apply for permanent residence in Canada were issued to eligible candidates in the month of February 2021. 

 

This can be seen as a sign of relief and more new aspirants can be expected to immigrate to Canada very soon.

ITAs For Canada PR Under Express Entry 

 

Canada Express Entry is a long-drawn two-step process. 

 

As it manages the application database for three federal immigration programs – the Federal Skilled Worker (FSW), the Federal Skills Trades (FSTP), and the Canadian Experience Class (CEC) – aspirants are first required to qualify for individual program requirements. Such eligible profiles are assessed and ranked on a Comprehensive Ranking System (CRS). Core human factors such as age, education, language skills, and work experience are used to calculate a CRS profile score. 

 

The second step will involve the fortnightly nomination draws held by IRCC. The high-ranking candidates based on the CRS score get invitations to apply (ITA) for permanent residence (PR).

Provincial Nominations To Qualify For Canada PR

Yet another month passed by and Canada immigration remained upbeat with provincial programs issuing nominations to eligible candidates to apply for permanent residence in Canada. 

 

The unique arrangement between the federal and provincial/territorial governments in Canada allows the nomination of foreign candidates separately based on the unique labor demand of each province. Later on, these provincial nominations allow eligible candidates to apply for permanent residence. 

 

Canadian provinces such as Alberta, British Columbia, Manitoba, Prince Edward Islands, Saskatchewan had remained active by conducting nomination draws to invite eligible candidates to apply for a provincial nomination. Thereon, getting a permanent residence in Canada becomes easier.

 

Further, candidates with an active Express Entry and a provincial nomination are at an extreme advantage. By virtue of their nomination, they are awarded an additional 600 points towards their overall CRS score. This would effectively guarantee them an ITA for Canada PR in a subsequent Express Entry draw.

February 10 200 Candidates invited under the Alberta Express Entry stream needed a CRS score of at least 301. Further, they were also required to have work experience in any occupation that supports the province’s economic development and diversification priorities.
British Columbia – February 02 216  Select candidates that include Entrepreneurs, Skilled Workers & International Graduates under the Express Entry BC (EEBC) and Skills Immigration streams.

The cut-off scores for Express Entry BC subcategories were:

  • Skilled Worker: 104
  • International Graduate: 100

The cut-off scores for the three Skills Immigration subcategories were:

  • Skilled Worker: 98
  • International Graduate: 98
  • Entry Level and Semi-Skilled: 79
February 09 – Tech Pilot Draw 74 Skilled worker and international graduate subcategories needed a qualifying provincial nomination score of 80, in addition to qualifying for one of 29 in-demand tech occupations
February 16 494 459 invitations to apply for provincial nominations were issued to candidates in the Skilled Worker, International Graduate as well as Entry Level and Semi-Skilled sub-categories of SI and EEBC streams in the first draws. 

The remaining 35 invitations went to candidates having work experience as retail and wholesale trade managers, restaurant and foodservice managers in another draw. 

February 23 – Tech Pilot Draw 87 Candidates with a provincial score of 75 points under Express Entry British Columbia (EEBC) and Skills Immigration (SI) categories.  
Saskatchewan – February 11  541 International Skilled Worker category through two subcategories: Express Entry, and Occupations In-Demand.

Ontario – February 02 484 Express Entry candidates whose Comprehensive Ranking System scores ranged between 466 and 467.

Further, candidates with at least one year of work experience and only in the 10 selected jobs qualified for this draw.

February 16 – Tech Pilot Draw 1,186 Invitations to Express Entry candidates were issued under the Human Capital Priorities stream and having CRS scores between 453 and 467. 

Additionally, such candidates needed to have word experience in selected 6 tech occupations. 

Manitoba – February 12 296
  • Skilled Workers in Manitoba: 240 LAAs and a minimum score of 514;
  • Skilled Workers Overseas: 23 LAAs and a minimum score of 676; and
  • International Education Stream: 33 LAAs (no EOI score requirement).

Further, a total of 20 LAAs went to Express Entry candidates.

  • Skilled Workers in Manitoba: 158 LAAs and a minimum score of 457;
  • Skilled Workers Overseas: 21 LAAs and a minimum score of 698; and
  • International Education Stream: 28 LAAs (no EOI score requirement).

Further, five LAAs went to Express Entry candidates.

Prince Edward Island – February 18 121 Eligible candidates were invited under Express Entry, Labour Impact and

Business Impact categories.

Australian Government has recently established its intention to rebuild its economy through immigration. It will triple the visa quota to be issued under the Global Talent Independent Program (GTI) for the upcoming program year.

It was launched with an intention to fulfil labour demand and opportunities in very new occupations and new sectors as existing occupation visa based models were proven inadequate. 

Earlier, the Department of Home Affairs explained, “when a new occupation emerges, it is a challenge to fit them under the Australian and New Zealand Standard Classification of Occupations (ANZSCO) list of classification. This list primarily provides information on the skill levels, qualifications and experience required to be eligible for a skilled working visa. But when it comes to new occupations belonging to future-focus industries, this classification can be a bit difficult in terms of skilled migration context. For such occupations, GTI program proves to be effective.”

However, the unveiling of its new 2021-2023 Immigration Levels Plan has promised to increase the newcomer levels significantly. Canada is likely to welcome around 80,000 immigrants per year under the spousal, partner, and children category.

 

As reported in the Toronto Star, a total of 15,999 files were finalized between October and December 2020 in which two-thirds of the applications were from people outside Canada.

 

Following the new immigration mandate letter, the Immigration, Refugees, Citizenship, and Canada (IRCC) seeks to implement pilot projects to fast track the family sponsorship programs. It involves the digital handling of applications for quick processing and interview schedules. Here in this blog, we would like to give you a brief on how you can sponsor your spouse and settle in Canada. 

 

Family Sponsorship From Within vs Outside Canada

IRCC allows citizens or permanent residents to apply to sponsor their spouses, common-law partners, dependent children, and conjugal partners from abroad. This would depend on their proof of submission that they will move back to Canada when their sponsored family member becomes a permanent resident.

 

This proof of submission could be a confirmation of employment for the sponsored member, or a land title, etc. Every case will be different, and the final outcome depends on the visa officer who is reviewing the file.

 

If you are applying with your partner who is living with you in Canada, the process has slightly different steps than if you were applying from abroad. 

 

The Spouse or Common-Law Partner in-Canada class is for Canadian citizens and permanent residents who are already living together in Canada and want to obtain permanent residence. However, under the Outland Spousal or Common-Law Partner Sponsorship, Canadians or permanent residents may sponsor their spouse or common-law partner for permanent residence in Canada, regardless of their place of residence.

 

Eligibility Requirements For Sponsors

  • You can be a permanent residence or a Canadian citizen, over the age of 18.
  • You will also have to prove that you can support them financially and make sure that they don’t need social assistance from the government.
  • Factors that could render you ineligible are like if you were ever convicted of a violent crime for example.

 

Eligibility Requirement For Spouse To Be Sponsored

They must be over the age of 18 and pass the necessary security, and medical checks. Also, the federal government specified that your relationship must be “genuine”. This leads to the quantification of relationship based on: 

 

  • Your spouse must be legally married to you and be at least 18 years of age. 
  • Common-law partners must be at least 18 years old and have lived with you for a minimum of 12 consecutive months. 
  • Conjugal partners must be 18 years old at least, have been in a relationship with you for a minimum of 12 consecutive months, reside outside of Canada, and are unable to live with you in their country or marry you due to significant obstacles. For example, if same-sex marriage is not allowed in your home country.

 

After establishing your eligibility for family sponsorship, you may have to submit two different applications to IRCC: 

 

  • a sponsorship application, and 
  • a permanent residence application.

 

Apply For Canada PR With Your Spouse

 

Step 1: Obtain an application package from IRCC.

 

Step 2: Pay your application fees to IRCC which tend to include processing fees, right of permanent residence fee, and biometrics fee. You need to pay these fees on IRCC’s website.

 

Step 3: Mail or submit online your completed application to IRCC.

 

The standard processing time is 12 months

 

During the processing period, IRCC may ask the applicant to submit and verify their biometrics or ask for an in-person interview. Those being sponsored will also be given 30 days to have a medical exam.

  • Various reports and surveys, including the WES report show an increase in interest in immigration to Canada despite the travel restrictions still in place.

He expressed his views on various platforms time and again, summarizing his government’s intention to continue to welcome more immigrants. In one of his public appearances, he mentioned:

Non-Disclosure Of Information Can Affect Your Chances Of Immigration

Who says an application for Immigration cannot be filled by self?

Of course, it can. Perhaps, you should. But there’s an obvious problem. 

 

The applicants need to go through every rule/regulation, predict one’s chances, pick the right visa category, all for a quick approval. However, a recent ruling passed by the Federal Court of Canada highlights the severe consequences of giving false or incomplete information when submitting an immigration application.

 

The court said, “If a person makes such a mistake, s/he has to give a credible explanation for it. If the individual does not, s/he can be subject to a five-year ban on applying for any kind of status in Canada.”

Real Case-Study

 

Ms. Carmen Muniz, a Mexican national, migrated to Canada in 2013 on a visitor visa. She would later go on to extend her stay in Canada through a series of the visitor, work, and study permits. Around 2019, she applied for a Post-Graduation Work Permit (PGWP) to allow her to remain in Canada. 

 

Taking note of all these is Immigration, Refugees, and Citizenship Canada (IRCC). The officer-in-charge there rejected her applications, apparently, because they had concerns Ms. Muniz would leave Canada at or before the expiration of her authorized stay.

 

On learning about this refusal, Ms. Muniz then applied instead for an electronic Travel Authorization (eTA). However, she is said to have answered negatively to the questionnaire that asks whether a person has ever been refused entry to, or extension of, one’s time in Canada (or any other country), or ever been asked to leave. 

 

But naturally, IRCC reacted to her negative reply and noted that Ms. Muniz may be found inadmissible for failing to declare material information on her application. IRCC also refuted her claim sent later the same day, confirming that she had indeed been refused a PGWP. She also explained that she did not intend to lie, but had misunderstood the question.

 

Further, IRCC concluded that Ms. Muniz had committed misrepresentation and was therefore inadmissible to Canada for a period of five years.

 

Although Ms. Muniz took her appeal for judicial review, the federal court upheld the decision of IRCC.

  • Priority will also be given to Australian visa applicants who are already on temporary visas inside Australia. In this way, Partner visa applications will benefit the most.

You have to obtain a Work Permit to arrive and set-up your business in Canada. Meanwhile, your spouse or common-law partner may apply for an open work permit. Dependent minors will be eligible for study permits to attend elementary or secondary school (if applicable).

Are exploratory visits mandatory?

 

No, they are not mandatory for Base Category but it’s recommended for forging up your plan better
Should the investments be proven as Liquid Investments? BC PNP only requires proof of your net worth which can include assets such as stocks, bonds, and real property.

The COVID-19 pandemic has unsettled the global economic, political and social scenarios in unprecedented ways, demanding concrete and immediate action from the governments to reduce the impact. According to a survey conducted by Deep Knowledge Group, Canada’s response to COVID-19 is ranked among the top 15 in the world. Deep Knowledge Group, a consortium of commercial and non-profit organizations, studied the response of more than 150 countries based on 78 different parameters. Canada has 13th rank in the report, preceded by Austria in the 12th place and Switzerland in the 11th. Canada is way ahead of the United States, which is in the 70th spot.

Canada’s Economic Response Plan

The COVID-19 Economic Response Plan of Canada provides around $100 billion as financial aid to the businesses, families and individuals affected by the crisis. As of April, 6 million Canadians have applied for Canada Emergency Response Benefit(CERB). Under the scheme, the Canadians who are financially affected by the pandemic would receive $500 per week for up to 16 weeks. The CERB is the cornerstone of the COVID-19 Economic Response Plan of Canada. It includes a new loan program for businesses and deferred deadlines for the payment of taxes. Besides the federal plan, 10 of the Canadian provinces have also announced their respective individual rescue packages to support the businesses and individuals affected by the crisis.

Benefits for workers

A number of benefits are available for workers under the relief plan of Canada. The most important relief scheme for them is the Canada Emergency Response Benefit(CERB), under which the workers who lose their income because of the COVID-19 crisis will receive $2000 a month for upto four months. Even those candidates who are not eligible for Employment Insurance(EI) payments are covered under the CERB scheme. The scheme also covers workers who have lost their jobs, those who are sick or quarantined or taking care of someone suffering from COVID-19. Further, working parents who have to stay home to take care of their children because of school and daycare closures can also be benefited from the scheme.

Further, the government has waived one-week waiting period to claim sickness benefits under Employment Insurance(EI)for those who are in imposed quarantine. The workers need not provide a medical certificate to enjoy these benefits.

Residential, farm and small commercial customers can request to defer their bill payments for electricity and natural gas for the next 90 days and the services will not be cut off.

Families

Canada is a country that gives high importance to families and the government has announced a number of relief measures for the families affected by the COVID-19 crisis. The government is providing a one-time special payment through the Goods and Services Tax Credit(GSTC) for low and modest-income families. As a result, the maximum annual GSTC payment amounts will double for the 2019-20 benefit year. So the maximum one-time payment for a single individual will be $443 and for couples, it will be $580.

For families with children, the government has increased the maximum annual Canada Child Benefit(CCB) amounts up to $300 per child for the benefit year of 2019-20 with their regular May 2020 payment. In effect, a single parent with two children with a low or modest income would receive close to $1,500 as additional short-term support.

In addition, the Canada government will increase the Canada Child Benefit(CCB) this year too as in the previous years. The increase will come into effect in July and is expected to provide relief to the families affected financially by the pandemic. As a result, families would get a maximum yearly benefit of $6,765 per child under the age of 6 and $5,708 per child between the age of 6 and 17.

 

Benefits for international students

The international students who need to extend their stay in Canada during this period are eligible for implied status. It means they may continue to work or study in Canada on their original permit during the period till the Immigration Refugees and Citizenship Canada (IRCC) takes a decision on their work/study permit extension application.

In normal terms, international students are allowed to work for a maximum of 20 hours per week. The government has lifted this restriction and students working in 10 priority sectors that are helping to fight COVID-19 can work for more than 20 hours per week until August 31. Further, international students who meet the CERB’s eligibility criteria can also receive income support from the government. The international students with work experience in Canada stand in advantage as Canada is increasingly targeting immigration candidates with Canadian experience in the Express Entry draws.
